Terms of Service
Effective and last updated: September 2, 2026. Please read these terms carefully before booking a test or using this website.
These Terms of Service ("Terms") govern your use of radonandco.com (the "Site") and any radon measurement services (the "Services") provided by RADON & CO, an independent radon measurement business operated by Ali-Reza Rizwani, NRPP Radon Measurement Professional #115300-RMP ("RADON & CO," "we," "us," or "our"). By booking a test, using the Site, or otherwise engaging our Services, you ("you," "Client," or "user") agree to be bound by these Terms. If you do not agree, do not use the Site or Services.
1. Nature of our services
RADON & CO provides independent radon gas measurement services only, using NRPP-protocol continuous radon monitors over a minimum 48-hour closed-house testing period. We do not perform radon mitigation, remediation, or any construction, plumbing, or HVAC work. To avoid a conflict of interest, NRPP-certified radon measurement professionals are prohibited from performing mitigation on properties they test. If a test result is elevated, we will explain the result and can refer you to independent, licensed mitigation contractors, but we make no representation about and assume no responsibility for the work of any third-party contractor we refer or that you separately engage.
2. Test results reflect a specific time period only
A radon test result reflects radon concentrations measured during the specific testing window at the specific location tested, under the specific closed-house conditions maintained during that window — nothing more. Radon levels in any structure fluctuate based on weather, barometric pressure, seasonal changes, ventilation, occupant behavior, foundation and soil conditions, and renovations, and can differ meaningfully from one testing period to the next, or between different locations in the same building. We make no representation, warranty, or guarantee, express or implied, that a test result reflects radon levels at any time other than the specific testing period measured, or that future testing at the same or a nearby location will produce a similar result. Any statistic, average, or map published on this Site (including the Radon Levels Map) is provided for general informational purposes only and is not a substitute for testing a specific property.
3. Closed-house conditions and test validity
A valid test requires closed-house conditions be maintained before and throughout the testing period, per ANSI/AARST protocol. If closed-house conditions are violated, doors or windows are opened for anything beyond normal momentary entry/exit, the monitor is moved, tampered with, or unplugged, or access is denied or interrupted during the testing window, the test may be invalidated. An invalidated test is not eligible for a refund, and re-testing will be offered at our then-current rate. You are responsible for informing any other occupants of the property of these requirements.
4. Scheduling, payment, and cancellation
Payment is due as specified at the time of booking. Scheduled appointments require reasonable advance notice to cancel or reschedule. If we arrive at the scheduled appointment time and are unable to access the property, or if an appointment is cancelled or rescheduled with less than 24 hours' notice, a $100 no-show/late-cancellation fee applies and will be charged using the payment method on file. This fee reflects the cost of reserved technician time and travel and is separate from, and in addition to, the cost of any rescheduled test.
5. No warranty; disclaimer
THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any information on the Site (including the Radon Levels Map, knowledge-base articles, or FAQ content) is complete, accurate, or current. Nothing on this Site constitutes legal, medical, engineering, or real estate advice.
6. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) RADON & CO'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THIS SITE, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID RADON & CO FOR THE SPECIFIC TEST GIVING RISE TO THE CLAIM; AND (b) RADON & CO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REAL ESTATE TRANSACTIONS, DELAYED CLOSINGS, DIMINISHED PROPERTY VALUE, RELOCATION COSTS, OR PERSONAL INJURY OR HEALTH-RELATED CLAIMS OF ANY KIND, EVEN IF RADON & CO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you to that extent.
7. Data and content ownership; use of test data
All content on this Site — including text, design, and the aggregated radon test datasets published on the Radon Levels Map and elsewhere — is the property of RADON & CO and is protected by copyright and other intellectual property laws. You may not scrape, reproduce, republish, redistribute, or use this data or content for commercial purposes without our prior written permission. Requests for data access by researchers, journalists, public health professionals, or other legitimate parties may be directed to radonandco@gmail.com and will be considered on a case-by-case basis.
By engaging our Services, you acknowledge and agree that RADON & CO may compile, aggregate, anonymize, and publish or otherwise use radon test result data (excluding your name and exact street address) — including on the Radon Levels Map, in marketing materials, and in communications with researchers or the public — for general informational, research, and business purposes. We do not publish your name, exact address, or other personally identifying information alongside test result data.
8. Indemnification
You agree to indemnify, defend, and hold harmless RADON & CO and its owner from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these Terms; (b) inaccurate or incomplete information you provide to us; (c) your violation of any law or third-party right; or (d) a third party's claim arising from your use of a test result we provided you (for example, in a real estate transaction, dispute, or legal proceeding).
9. Governing law and dispute resolution
These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles. Before filing a claim, you agree to first contact us at radonandco@gmail.com so we can attempt to resolve the dispute informally. Any dispute that cannot be resolved informally shall be resolved by binding individual arbitration rather than in court, except that either party may bring an individual claim in small claims court. You and RADON & CO each waive any right to a jury trial or to participate in a class action. This arbitration provision does not apply to disputes that applicable law does not permit to be arbitrated.
10. Changes to these Terms
We may update these Terms from time to time. The "last updated" date above reflects the most recent revision. Continued use of the Site or Services after changes are posted constitutes acceptance of the revised Terms.
11. Severability and entire agreement
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and RADON & CO regarding the Site and Services.
